By submitting and/or uploading your testimonial success story, photographs, video or other content (the “Content”), you automatically consent and grant to Total Gym Fitness, LLC and its affiliates (“TGL”), the irrevocable right and permission to use, copy, reproduce, publish, and/or publicly display your name and any Content submitted by you. Such right shall be worldwide, in perpetuity, and may be used in any form of media, advertisements, promotion or for any other lawful trade purposes as determined by TGL, in its sole discretion, as it pertains to the Total Gym® product, without compensation to you. You may be required to sign a Release before any Content is displayed. You acknowledge that the Content submitted shall become the property of TGL and will not be returned to you. You declare that (i) any statements or endorsement made by you are factually accurate and represent your honest opinion and experience, (ii) there exists no material connection between yourself and TGL, (iii) you are the owner of (or authorized to give) this submission and the Content does not infringe on the rights of any other persons, and (iv) you are 18 years of age or older. TGL has no obligation to, and may elect not to use any submitted Content, takes no responsibility, and assumes no liability, for the Content provided by you.
